Who can use Act It Up
You must be at least 13. If you are under 18, you may use Act It Up only with the involvement of a parent or legal guardian, and they must agree to these terms on your behalf. Accounts we find to belong to someone under 13 are deleted.
You may hold one account. You are responsible for what happens under it, and for keeping access to the email address it is registered to.
Your content
Your performances remain yours. We claim no ownership of what you record.
To run the service we need permission to handle it: you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transcode, reproduce, and display your content for the purpose of operating and promoting Act It Up. That licence exists so the app can put your video on other people's screens, and it ends when you delete the content, except for copies already made by people who saw it and copies we are required to retain.
You confirm you have the right to post what you post — including the right to any music, likeness, or other material in it.
What you may not do
- Post sexual content involving minors, or any content that sexualises a minor. This is reported to the authorities and ends the account permanently.
- Post sexual content of any kind, including nudity, sexual acts, and sexually explicit dialogue. The audience includes 13-year-olds and the standard is what they could watch.
- Post content that attacks or demeans people for who they are — race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation, or age — including slurs, dehumanising language, and hate symbols. A scene may contain a bigoted character; it may not be a vehicle for saying the thing.
- Post content that harasses, threatens, impersonates, or incites violence.
- Post someone else's work as your own, or record a person who has not agreed to be recorded.
- Manipulate rankings, gifts, or points — including with multiple accounts, automation, or bought engagement.
- Reverse engineer the app, interfere with its infrastructure, or scrape it.
We may remove content or close an account for breaking these rules. Where it is reasonable to do so, we will say why.
The Community Guidelines say what these rules mean in practice, in the words used inside the app — including what a report is for, what happens after one, and what stays allowed. The list above is the binding version; that page is the readable one, and the two are written to say the same thing.
Coins
Coins are a virtual item bought through Apple's in-app purchase and used to send gifts to creators.
- Coins have no monetary value and are not your property.
- They cannot be transferred between accounts, sold, or exchanged for cash.
- They are not refundable by us. Purchases are made through Apple, so any refund is Apple's decision, requested through Apple.
- Unused coins are lost when an account is closed, by you or by us.
- We may change what coins cost or what gifts cost in future, and will not apply a change retroactively to coins you already hold.
Points and payouts
Gifts sent to you become points. Points can be converted to money once your balance reaches the published minimum, which is currently 10,000 points — fifty US dollars at half a cent each.
Payouts are made through Stripe, and require a Stripe Connect account that has passed Stripe's identity verification and remains in good standing. If you are under 18, a parent or legal guardian completes that verification and owns the account the money is paid into.
We may withhold or reverse a payout where there is a credible indication of fraud, manipulated engagement, or a breach of these terms, and while such a case is being reviewed. We may change the conversion rate or the minimum for points earned in future; points you have already earned convert at the rate published when you earned them.
Advertising
The app shows ads, including an optional rewarded video you may choose to watch. Where consent is required for personalised advertising, it is asked for before any such ad is requested and can be changed at any time in the app.
Sponsored scenes
On a small number of days, the scene is paid for by a company. A sponsored scene replaces that day's scene rather than being an additional one, and no more than four days in any thirty may be sponsored.
Every sponsored scene is labelled “Presented by” the company that paid for it. The label appears on the challenge card and on the scene itself, before you perform it.
We write the scene. A sponsor tells us what they would like it to be about; they do not supply the script. A sponsored scene is held to the same standards as every other one, including being suitable for a 13-year-old.
Sponsorship buys the day and nothing else. It does not affect how performances are moderated, how they are ranked or shown in feeds, or how coins and payouts are calculated.
Your performance of a sponsored scene remains yours. We do not license it to the sponsor and we do not use it to advertise them.
Ending it
You may delete your account at any time from Settings; what that removes and what it keeps is set out on the account deletion page.
We may suspend or close an account that breaks these terms, or where we are required to by law. Anything you have already earned and are owed remains payable unless it is the subject of a fraud review.
The parts lawyers require
The service is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or that it will get you work. To the extent the law allows, EveeShare LLC is not liable for indirect, incidental, or consequential damages, and our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.
These terms are governed by the laws of the State of Florida, and the courts of Florida have jurisdiction over disputes arising from them.
Changes
If we change these terms in a way that materially affects you, we will say so in the app before the change takes effect. Continuing to use Act It Up after that means accepting the new version.
